Remember your Cool Point?

1.1 The "Cool Point 30 Years" photo and caption contest (the "Contest") is run by Coolpoint Hotel Sdn. Bhd. (Reg. No. 199301022348 (277086-T)) (the "Organiser") of 891, Persiaran Dayang Endah, 39000 Tanah Rata, Cameron Highlands, Pahang, Malaysia, which operates The Cool Point Hotel and Cool Point Club (the "Hotel").

1.2 By entering, a participant ("you") confirms that you have read, understood and accepted these Terms and Conditions (the "Terms").

1.3 The Contest is not sponsored, endorsed or administered by, or associated with, Instagram, Facebook, Threads, Meta, TikTok or any other platform.

2.1 The Contest opens at 12:00 am on 10 October 2026 and closes at 11:59 pm on 31 December 2026, Malaysia time (UTC+8) (the "Contest Period").

2.2 Entries posted before or after the Contest Period are not valid.

3.1 The Contest is open to past and present guests of the Hotel who are aged 18 or over on the date of entry. Open to all nationalities.

3.2 The following are not eligible: employees, directors and contractors of the Hotel and the Organiser, the Contest judges, and their immediate family members (spouse, parents, children and siblings).

3.3 The Hotel may ask for proof of eligibility, identity and age, and for evidence of a past stay or visit, such as a booking record, receipt or other reasonable proof, before awarding the Prize.

4.1 To enter, you must, during the Contest Period:

• (a) find an old photograph (a print, scan or earlier digital photo) taken at The Cool Point Hotel that shows your favourite spot (your "Cool Point");

• (b) post it publicly on your own Instagram, TikTok or Threads account, or as a public comment on the Contest post on the Hotel's Facebook Page, with a caption of fewer than 100 words describing the memory behind it (hashtags and tags are not counted);

• (c) tag the Hotel as follows: @coolpoint.hotel and @coolpointclub on Instagram; @coolpoint.hotel on Threads; @coolpointhotel on TikTok; or by commenting on the Contest post on the Hotel's Facebook Page (The Cool Point Hotel, Cameron Highlands); and

• (d) include the hashtag #CoolPointClub.

4.2 One entry per person per platform. The Contest runs at the same time on Instagram, TikTok, Facebook and Threads, and the same Contest Period applies to all four. A person may therefore enter once on each of the four platforms, up to four entries in total. Further entries by the same person on the same platform are not counted.

4.3 Your post must remain public and undeleted until the winner has been announced and, if you are the winner, until the Prize has been paid. Entries that are deleted, made private or edited to break these Terms may be disqualified.

4.4 Facebook entries: enter only by commenting on the Contest post on the Hotel's Facebook Page, with your photo and caption. Posts on a personal timeline are not valid entries.

4.5 Entries made by an agent, a group, an automated process or a third party on your behalf are not valid.

5.1 Your photo and caption must be your own original work, or you must own or control the rights needed to enter them, and they must have been taken at or relate to the Hotel.

5.2 Your entry must not contain anything that, in the Hotel's reasonable opinion, is unlawful, defamatory, obscene, discriminatory, hateful, political, misleading or infringing of anyone's rights, or that is likely to harm the Hotel's reputation.

5.3 Your entry must not contain third-party logos, brands, music or other copyright material that you have no right to use.

5.4 Light editing, scanning, cropping and filters are allowed. An entry must not be materially altered or AI-generated so as to misrepresent the original photo or its date.

5.5 The Hotel may remove, hide or decline to count any entry that does not meet these Terms, without notice.

6.1 You keep ownership of your photo and caption.

6.2 By entering, you grant the Hotel and the Organiser a non-exclusive, royalty-free, worldwide, perpetual licence to display, share and repost your entry (with light cropping or resizing), with credit to your social media handle where practical, to showcase and share the Hotel's memories at its premises, not for profit, including on the Hotel's and the Cool Point Club's social media channels, website, in-hotel displays and anniversary or heritage materials for the Hotel's 30th anniversary.

6.3 This licence is for sharing and showcasing only. The Hotel will not sell your entry or use it for commercial advertising or profit.

6.4 You may ask the Hotel in writing to stop future uses of your entry (other than the winner announcement and material already published or printed), and the Hotel will act on a reasonable request within 30 days.

7.1 If any identifiable person appears in your photo, you confirm that you have their permission to enter the photo and for the uses in clause 6, or that you reasonably believe the photo was taken in circumstances where such use would be expected.

7.2 Photos in which a person under 18 is identifiable may be entered only if a parent or guardian has agreed.

7.3 If anyone in an entry asks the Hotel to remove it, the Hotel may remove or stop using the entry, and you agree to cooperate.

8.1 You warrant that your entry is accurate and complies with clauses 5 and 7, and that it does not infringe any person's copyright, privacy, confidentiality or other rights.

8.2 You agree to compensate the Hotel for loss, claims and reasonable costs the Hotel suffers because your entry breaches this clause.

9.1 There will be one winner. The winner will be chosen by the Hotel's management (the "Judges") after the Contest closes.

9.2 The Judges will consider, among other things, the genuine nostalgia and personal story in the caption, the connection to The Cool Point Hotel, the charm and character of the photo, and creativity. Likes, views and shares are not counted.

9.3 The Judges' decision is final. No correspondence will be entered into, and no reasons need be given. There is no right of appeal.

9.4 The Judges may decline to award the Prize if no entry meets the standard they consider appropriate.

10.1 The Prize is (a) RM1,000 in cash and (b) lifetime membership of the Cool Point Club, with the same benefits as paid members, for the winner, if the winner is not already a member (see the membership terms on our website).

10.2 The cash prize will be paid by bank transfer to a bank account in the winner's own name within 30 days after the winner's details have been verified under clause 11. No cash-equivalent, cheque or other payment method is offered.

10.3 The Prize is non-transferable and cannot be exchanged, split or redeemed for anything else. If the winner is already a Cool Point Club member, the winner receives the cash prize only.

10.4 The winner's lifetime Cool Point Club membership is granted without payment of the Club's one-time membership fee. It is otherwise subject to the Club's own terms and conditions (effective 7 March 2026, as amended from time to time), including that membership is personal and non-transferable.

10.5 The winner is responsible for any tax, duty or bank charges that arise on the Prize, if any.

11.1 The winner will be announced on @coolpoint.hotel and @coolpointclub on or about 20 January 2027 and contacted through the account used to enter, by direct message or comment.

11.2 The winner must respond within 7 days and provide the information the Hotel reasonably asks for, including full name, a copy of identification showing age, contact details, bank account details in their own name, and proof of a past or present stay.

11.3 If the winner does not respond in time, cannot be verified, or is found not to meet these Terms, the Hotel may withdraw the Prize and award it to another entrant chosen by the Judges, or decide not to award it.

11.4 The winner agrees that the Hotel may publish their name, social media handle and entry, and may take and use a photograph of the prize presentation, for announcements and promotion of the Contest, without further payment.

12.1 The Hotel may disqualify an entrant, and withhold or recover the Prize, if the Hotel reasonably believes that the entrant:

• (a) has broken these Terms or the platform's rules;

• (b) gave false or misleading information, or used a false, anonymous or duplicate account;

• (c) used bots, scripts or paid services to enter or to gain visibility;

• (d) posted an entry that is not their own, or not taken at the Hotel; or

• (e) behaved in an abusive or fraudulent way toward the Hotel, its staff or other entrants.

13.1 The Hotel will handle personal data collected for the Contest in line with the Personal Data Protection Act 2010 of Malaysia.

13.2 Data collected: your social media handle and the content of your entry, and, for the winner, name, identification details, contact details, bank account details and proof of stay.

13.3 Purposes: running and judging the Contest, verifying eligibility, announcing the winner, paying the Prize, enrolling the winner in the Cool Point Club, and promoting the Hotel's anniversary as set out in clause 6 and clause 11.4.

13.4 Disclosure: to the Hotel's staff, the Cool Point Club, banks and payment providers, professional advisers, regulators where required by law, and the platforms on which you post. Your entry is public on the platform you chose, and the Hotel does not control how the platform handles it.

13.5 Retention: entry data is kept for 12 months after the Contest. Winner and payment records are kept for as long as the law requires.

13.6 You may request access to or correction of your personal data, or withdraw consent, by writing to management@coolpointch.com. Withdrawing consent may mean your entry cannot be considered.

14.1 The Contest is not administered by, or connected with, Instagram, Facebook, Threads, Meta or TikTok. You must follow each platform's terms of use while taking part.

14.2 You release each platform from any claim arising from the Contest. Questions and complaints about the Contest go to the Hotel, not to the platforms.

15.1 To the extent the law allows, the Hotel and the Organiser, and their staff, will not be liable for any loss, damage or injury arising from your taking part in the Contest or receiving the Prize, including technical faults, platform outages, late, lost or misdirected entries or messages, or the loss of any photo.

15.2 Nothing in these Terms limits any liability that cannot lawfully be limited or excluded.

15.3 You are responsible for keeping your original photo safe. The Hotel does not return photos or take responsibility for original prints.

16.1 The Hotel may change these Terms, extend or shorten the Contest Period, or suspend or cancel the Contest, if circumstances beyond its reasonable control arise (including technical failure, fraud, legal or regulatory change, or force majeure).

16.2 Any change will be published at www.coolpointch.com/contest and applies from the time it is published, but will not affect an entry already judged.

17.1 These Terms, together with any announcement published at www.coolpointch.com/contest, are the full terms of the Contest.

17.2 If any part of these Terms is found unenforceable, the rest remains in force. A failure to enforce a right is not a waiver of it.

17.3 These Terms are written in English. If there is a translation, the English version prevails.

17.4 These Terms are governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any dispute arising from the Contest.
